Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Mindless Budget LLC, an Indiana limited liability company (“Mindless Budget”, “we”, “us”), covering your use of the Mindless Budget application and websites (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.
1. What Mindless Budget is (and isn’t)
Mindless Budget is a zero-based budgeting tool: it helps you plan your money, track transactions, and stay on top of savings goals. To be clear about what it is not:
- We are not a bank and we never hold, move, or have access to your money. Bank connections are read-only views of your account data, provided through Plaid.
- We do not provide financial, investment, tax, or legal advice. Everything the Service shows you — including anything the AI assistant says — is informational and educational. It may be wrong, incomplete, or out of date, and it is not a substitute for a qualified professional. Decisions about your money are yours alone.
2. Eligibility and your account
- You must be at least 18 years old and able to form a binding contract.
- Provide accurate account information and keep your password secure. You are responsible for activity under your account. We strongly recommend enabling two-factor authentication.
- One account per person, for personal (non-commercial) use.
3. Bank connections through Plaid
Linking a bank account uses Plaid Inc. You provide your bank credentials directly to Plaid — never to us — and you authorize us to receive your account and transaction data from Plaid to operate the Service. Your use of Plaid is subject to Plaid’s End User Privacy Policy. Bank data may occasionally be delayed, incomplete, or inaccurate as delivered by your institution or Plaid; verify balances with your bank before relying on them.
4. The AI assistant
- AI responses are generated automatically and can be inaccurate. Double-check anything important.
- At your direction, the assistant can make changes to your budget (for example, adding or editing budget items). You are responsible for reviewing changes it makes; an undo is provided.
- AI features are subject to fair-use limits and may be throttled or temporarily unavailable.
5. Fees
During early access the Service is free and no one is charged. We plan to introduce a paid subscription (current advertised pricing: a free trial followed by an annual fee, as shown on our website); when billing launches we will give you advance notice, pricing will be clearly displayed before you commit, and you will never be charged without expressly signing up for a paid plan.
6. Your data
Your budget and financial data belong to you. You grant us the limited license needed to store and process that data solely to operate, secure, and improve the Service, as described in the Privacy Policy. You can export your data as JSON or permanently delete your account at any time from Account Settings.
7. Acceptable use
You agree not to: attempt to access other users’ data; probe, scan, or test the security of the Service without written permission; use automated tools to scrape or bulk-download the Service; interfere with its operation (including attempting to bypass rate limits); use the Service for unlawful purposes; or resell it. We may suspend or terminate accounts that violate these Terms or abuse the Service, with notice where practical. Security researchers acting in good faith are asked to contact security@mindlessbudget.com.
8. Availability and changes to the Service
The Service is provided without uptime guarantees, and features may change, be added, or be removed as it evolves. If we ever discontinue the Service entirely, we will give you reasonable advance notice and an opportunity to export your data.
9. Termination
You can stop using the Service or delete your account at any time — deletion is immediate, permanent, and removes your data as described in the Privacy Policy. We may suspend or terminate your access for violation of these Terms or if required to by law; where practical we will notify you first so you can export your data.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA (INCLUDING BANK DATA AND AI OUTPUT) WILL BE ACCURATE OR COMPLETE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDLESS BUDGET LLC AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) US $100 OR (B) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnification
You will indemnify and hold us harmless from claims and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Service.
13. Governing law and disputes
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-laws rules. Any dispute that we cannot resolve informally will be brought exclusively in the state or federal courts located in Indiana, and you consent to their jurisdiction. Before filing any claim, you agree to contact us at legal@mindlessbudget.com and give us 30 days to try to resolve it informally.
14. Changes to these Terms
We may update these Terms as the Service evolves. For material changes we will update the date above and notify you in the app or by email before they take effect; continued use after that constitutes acceptance. The current version is always at app.mindlessbudget.com/terms.
